These Terms of Use ("Terms") govern your use of Image to Text: Smart Summaries (the “App” or "Smart Summaries"), developed and operated by Dzianis Kuziomkin (“we”, “us”, or “our”).

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, do not use the App.

1. Description of the App

Image to Text: Smart Summaries is a document interpretation tool designed to help users understand documents from photos. The App extracts text, generates plain-language summaries, highlights key sections, and provides translations using Artificial Intelligence (AI).

Smart Summaries is an information and interpretation tool only. It does not provide legal, financial, medical, or professional advice.

2. No Professional Advice & AI Limitations

2.1. No Professional Advice

The content generated by Smart Summaries is provided for informational purposes only.

• The App does not provide legal advice, recommendations, or binding opinions.
• The App does not replace consultation with qualified lawyers, financial advisors, or medical professionals.
• You are responsible for reviewing original documents and deciding how to proceed.

2.2. AI Accuracy & Hallucinations

You acknowledge that the App uses Artificial Intelligence, which may occasionally generate incorrect, misleading, or "hallucinated" information.

• Summaries may omit critical details or misinterpret context.
• You should never sign a legal document or make a financial decision based solely on the App’s summary. Always verify the details against the original document.

3. Use of Third-Party AI Services

Smart Summaries uses a third-party AI model provider (Google Gemini API) to process document images and extracted text. By using the App, you acknowledge and agree that:

• Document images or extracted text are transmitted securely to the AI provider solely for processing.
• We do not store your document content on our own servers.
• We are not responsible for the availability or accuracy of the third-party AI service.

4. User Responsibilities

You agree to:

• Use the App only for lawful purposes.
• Ensure that you have the right/ownership to upload and process the documents you use with the App.
• Not use the App to process illegal content, including but not limited to fraudulent documents or Child Sexual Abuse Material (CSAM).
• You are solely responsible for the accuracy, completeness, and legality of the documents you process.

5. Data Storage and Privacy

Document images, extracted text, summaries, and translations are stored locally on your device. We do not operate user accounts, proprietary databases, or cloud storage for user data. For more information, please review our Privacy Policy.

6. Subscriptions and Payments

Some features of the App may require a paid subscription (e.g., "Smart Summaries Pro").

• Payment: Payment will be charged to your Apple ID account at the confirmation of purchase.
• Auto-Renewal: Subscription automatically renews unless it is canceled at least 24 hours before the end of the current period.
• Account Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Management: You can manage and cancel your subscriptions by going to your App Store Account Settings after purchase.
• No Refunds: We do not handle refunds directly. All refund requests must be managed through Apple Support.

7. Intellectual Property

The App, including its design, code, text, graphics, logos, and branding, is owned by Dzianis Kuziomkin and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or reverse engineer any part of the App without prior written permission.

8. Disclaimer of Warranties

The App is provided on an “AS IS” and “AS AVAILABLE” basis. We make no warranties or guarantees regarding:

• The accuracy, completeness, or reliability of summaries or translations.
• The availability or error-free operation of the App.
• The suitability of the App for any particular purpose, including legal compliance.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or related to your use of the App. This includes, without limitation, errors in document interpretation, loss of data, or decisions made based on information generated by the App. In no event shall our total liability exceed the amount you paid, if any, for accessing the App.

10. Termination

We reserve the right to suspend or terminate access to the App at any time if you violate these Terms or use the App in an unlawful manner.

11. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted with a revised “Last updated” date. Continued use of the App after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Poland (or applicable jurisdiction), without regard to conflict of law principles.
